Kelantan prince orders estranged wife to return by July 2



The Tengku Temenggong of Kelantan Tengku Muhammad Fakhry Sultan Ismail Petra has ordered his estranged wife Manohara Odelia Pinot to return to him by July 2, failing which he will proceed with legal action.

Stating that he was her lawful husband under Syariah law, he said Manohara's rightful place was by his side and that she should obey him as long as it was according to the law.

Tengku Muhammad Fakhry said this to Manohara in a letter that was passed to his lawyer in Indonesia to be forwarded to her.

A copy of the letter was also sent as a press release to the media by his lawyer Zainul Rijal Abu Bakar here yesterday.

Bahawasanya saya Tengku Muhammad Fakhry ibn Sultan Ismail Petra, Tengku Temenggong Kelantan, suami yang sah kepada Manohara Odelia Pinot, Cik Puan Temenggong Kelantan dengan ini mengarahkan isteri saya yang tersebut di atas kembali taat ke pangkuan saya, iaitu suami beliau yang sah di sisi Hukum Syarak serta menjalankan tanggungjawabnya sebagai isteri saya sebagaimana yang dituntut mengikut Hukum Syarak dan tugas sebagai Cik Puan Temenggong Kelantan sebagaimana yang diperakui oleh Undang-Undang.

Sekiranya isteri saya yang tersebut di atas tidak kembali taat kepada saya sebagaimana arahan yang tersebut di atas selewat-lewatnya pada atau sebelum 2hb Julai 2009, maka saya tidak akan teragak-agak untuk melaksanakan apa jua hak saya yang sah di sisi Hukum Syarak dan Undang-Undang tanpa merujuk terlebih dahulu kepada isteri saya yang tersebut di atas.

Saya menegaskan bahawa sesungguhnya tempat seorang isteri adalah di sisi suaminya. Isteri wajib mematuhi arahan dan perintah suaminya selagi mana ia tidak melanggar Hukum Syarak dan Undang-Undang.

Saya telah melantik Tuan Haji Zainul RIjal bin Abu Bakar, Peguam Sharie dari firma Tetuan Zainul RIjal Talha & AMir yang beralamat di Suite 15-5, Jalan USJ 9/5Q, Subang Business Centre, 47620 UEP Subang Jaya, Selangor Darul Ehsan, Malaysia bagi mengendalikan kes-kes syariah bagi pihak saya. Sebarang kemusykilan syariah bolehkan dikemukakan kepada peguam Syarie saya yang tersebut di atas.

Manakala bagi guaman sivil pula saya telah melantik En Mohd Haaziq Pillay dari Tetuan J S Pillay & Mohd Haaziq, Unit B-3A-3, Block B, Mega Avenue 1, 189, Jalan Tun Razak, 50400 Kuala Lujmpur bagi pihak saya. Sebarang kemusykilan mengenai undang-undang sivil bolehlah kemukakan kepada beliau.

Tengku Muhammad Fakhry's letter further read that he had engaged Zainul Rijal as his Syariah lawyer and Mohd Haziq Pillay as his civil lawyer.

Manohara, 17, a former Indonesian teen model, had fled from her husband on May 31 when they were in Singapore to visit his father, the Sultan of Kelantan, who was being treated at the Mount Elizabeth Hospital for a heart ailment.

She returned to Jakarta after accusing the 31-year-old prince of abusing her physically and sexually.

A medical examination in Jakarta allegedly stated she was repeatedly slashed with sharp objects on her chest and had been burnt with a cigar on her forehead.

Manohara is appointed as the Indonesian Anti-Narcotic Ambassador. Manohara is the most suitable person for this job.

The Head of National Anti-Narcotic Movement (GANNAS), I Nyoman Adi Feri said, “Even though Manohara is young, but she has principles, and she is a national asset, hence we have appointed her to carry out her duties.” Nyoman said this during a discussion with detikcom on Monday (29/06/2009).

Nyoman added, “Manohara’s current polemical issues with Fakhry, may not have been settled yet, but GANNAS is optimistic that Manohara is the most appropriate choice as an ambassador for the movement. Manohara has met our requirement, and to the best of our knowledge she is not addicted to drug or engaged in any distribution of drugs.

Prior to the appointment of Manohara, the post was held by Kapten Band racer, Alexandra Asma Subrata. The appointment of Manohara and the signing ceremony took place on Saturday (27/06/2009), at The Papilon Kemang, Jln Kemang Raya. Manohara’s lawyer Farhad Abbas was present during the ceremony, and also present was the head of Laskar Merah Putih, Eddy Hartawan. Daisy Fajarina accompanied Manohara to the ceremony.

Nyoman expects, in the long run, Manohara will become an icon in campaigning for youth to be free from drugs. He said, “We hope Manohara will carry the anti-narcotic message across to the younger generation, as she has already become a public figure who belongs to the people, and it is easier for her to achieve this aim.”

Mano Gets Own Royal Title in Solo

Solo. Former teenage model-cum-instant celebrity, Manohara Odelia Pinot, who shot to fame following her short-lived marriage to a Malaysian prince, now has a royal title of her very own.

Sunan Pakubuwono XIII Hangabehi, the head of the royal line in Solo, Central Java, bestowed the 17-year-old with the royal title of Kanjeng Mas Ayu as part of the pomp to mark his fifth anniversary on the throne.

The royal spokeswoman, Princess Gusti Raden Ayu Koes Murtiyah, said the award was an intellectual rebuke to the royal family of Kelantan, to which Manohara’s husband belongs.

“She was given the royal title because, first, she is still the legitimate wife of a prince,” she said. “And secondly, to remind the family of Tengku Fakhry that the domestic issues of a royal family should not be revealed so openly to the public.”

Manohara left her Malaysian husband Tengku Temenggong Muhammad Fakhry in May, claiming domestic abuse. Fakhry claims Manohara and her mother owe him more than 972,000 Malaysian ringgit ($272,000).

Gusti Murtiyah criticized the Kelantan court for failing to settle the marital problems quietly.

“Not every woman can marry a prince, or even a king. Manohara’s status was elevated by this privilege, but why does it have to turn into a disaster like this? Why hasn’t the Kelantan Sultanate sent a competent envoy to settle the matter? Why draw it out like this?” she said.

Manohara’s mother, Daisy Fajarina, claimed that her daughter had been mistreated, saying that she was not allowed to even visit Manohara while she was in Malaysia. Manohara famously ran away from the prince while his royal family was visiting Singapore.

The awarding of honorary titles by Solo’s ruler is an ostentatious tradition practiced to celebrate royal anniversaries. This year marks the fifth year on the throne for the current ruler, who controversially took the crown in 2004 after Pakubuwono XII died without leaving a clear heir.

Among the other recipients of the royal titles were Dorce Gamalama, a multitalented transsexual entertainer, who was bestowed with the title of Mas Ayu Tumenggung.

“I cannot express the happiness I feel in my heart,” Dorce said. “For me, the title constitutes a solemn moral responsibility that I have to bear.”

Gusti Murtiyah said that Dorce merited the title for her service to arts and culture.

In addition to the awarding of royal titles, this year’s ceremony was marked by a number of traditional festivities, and will conclude with the Tedhak Sinten ritual on Sunday — a public offering made by the Solo Royal Palace.

The festivities also included performances by the Srimpi Ludiromadu and Wireng Tohjoyo Rewantaka dance groups, as well as theater by Kusumoyudho.

“Any one can enter the palace grounds to watch the royal party,” Gusti Murtiyah said, adding however that palace protocol should be respected within the royal grounds.

Judgement in default entered against Manohara

KUALA LUMPUR: The High Court here today allowed Kelantan prince Tengku Muhammad Fakhry Sultan Ismail Petra to enter judgment in default in his RM105 million defamation suit against his estranged Indonesian model wife, Manohara Odelia Pinot, and her mother, Daisy Fajarina, after they failed to appoint counsel.

Senior Assistant Registrar Shazali Hidayat Shariff made the order in chambers.

A judgment in default is a binding decision made in favour of the plaintiff when a defendant does not respond to a summons or fails to appear before a
court.

On Oct 29, Shazali gave Manohara and her mother until today to appoint new lawyers or risk having a judgment in default entered against them.

Lawyer Mohd Haaziq Pillay, who represented the prince, told the media that the amount of the damages would be assessed by the court later.

Mohd Haaziq said the quantum was not the main issue. What his client wanted was to clear his name of the allegations made by Manohara and Daisy.

"Manohara and her mother should come and answer all the allegations that they had made against Tengku Muhammad Fakhry, but to date they have not furnished any proof to support their allegations," he said.

He said Shazali made the decision after the prince filed for a judgment in default against Manohara and Daisy for failing to appoint new counsel to defend
them.

On Oct 12, Messrs Fakrul Hisham Abdullah & Associates obtained on order from the High Court to discharge itself from representing Manohara and Daisy.

In the suit filed on July 20, the Kelantan prince claimed that the two had falsely and maliciously defamed him in allegations they made at news conferences between April and June about Manohara being abused.

Besides the defamation suit, the prince had also filed two other suits against Manohara in Syariah Court seeking her return to him and nearly RM1 million, which he claimed Manohara owed him.

Until today, Manohara and Daisy have yet to reply to Tengku Muhammad Fakhry's claims. -- Bernama

Manohara was never abused, says witness

THE Syariah High Court in Kota Baharu was told today that Manohara Odelia Pinot was never abused by her husband, the Tengku Temenggong of Kelantan, Tengku Muhammad Fakhry Sultan Ismail Petra.

Tengku Azwani Tengku Iskandar, 26, said the claims made by Manohara in a newspaper report that she was abused by her husband was not true.

"I was always with Manohara. If there was, she would have complained it to me," she said when questioned by Tengku Muhammad Fakhry's counsel, Zainul Rijal Abu Bakar, in the hearing of the prince's suit which sought Manohara to be loyal to him.

Tengku Azwani, who is the only witness in the case, said her house was only about 10 minutes walks from that of Tengku Muhammad Fakry's, who is her cousin.

She said she was close to the prince and Manohara and that the couple's relation could be regarded as good and affectionate.

At the hearing which was presided by judge Mohd Yusof Awang, the court also heard a written affidavit by Tengku Muhammad Fakhry on a suit for Manohara to return RM1,112,250 which she had borrowed from him.

Mohd. Yusof fixed Dec 13 for decision.Manohara was not at the court today nor was she represented in the court.

Last Friday, Tengku Muhammad Fakhry filed his affidavit to the Syariah High Court in Kuala Lumpur for validation and to be used as evidence in the hearing of his suits at the court here today.

On Nov 3, Syarie lawyers Mohd Faiz Adnan and Roshdan Sujak Rafie pulled out from representing Manohara in the two cases and two days after that a judgment in default was made against Manohara and her mother, Daisy Fajarina, in a RM10 million suit filed by the prince at the Kuala Lumpur High Court.

Manohara has been ordered to return to her husband

Indonesian model Manohara Odelia Pinot has been ordered to return to her husband Kelantan prince Muhammad Fakhry Sultan Ismail Petra, and pay him the 1.2 million ringgit (US$352,216) she borrowed from him.

Sharia High Court judge Mohd Yusof Awang, however, said the order would be enforced as soon as Muhammad Fakhry takes the Yamin Istizhar (explicit promise) oath in court on January 3.

The judge said the 18-year-old Indonesian former model had 14 days to return to her husband after he took the oath.

Last month, the prince won a defamation suit against Manohara and her mother over allegations that he had sexually abused the 17-year-old.

In May, the Indonesian model slipped away from the prince's guards at a Singapore hotel and returned to her family in Indonesia with tales of abuse, rape and torture at the hands of the 31-year-old prince.

“I am satisfied with the testimony provided by the plaintiff (Tengku Muhammad Fakhry) including those of the witnesses. After weighing the evidence, the court rules that the defendant (Manohara) should return to her husband and pay the money owed to her husband,” he said in his judgment.

The judge said if Manohara did not return to her husband, she is deemed to be derhaka (disloyal) and nyusyuz (recalcitrant) and therefore, did not deserve anything from her husband.

He said the court could not accept the argument that the amount of 1.2 million ringgit was a gift from Tengku Muhammad Fakhry, based on the non-appearance in court of Manohara throughout the proceedings.

Tengku Muhammad Fakhry was present in court while neither Manohara nor any of her lawyers turned up.

Mohd Yusof said the move by Manohara to run away to Indonesia and defame her husband in the Indonesian media was in violation of Islam.

“The plaintiff had treated her well during her stay at the Istana Mahkota,” he said, adding that what Manohara had enjoyed was “much more than other women had”.

In fact, the judge said, Manohara should have thanked her husband and the Kelantan royal family for taking good care of her.

“The plaintiff discharged his duty as a husband and there is no element of abuse as claimed by Manohara. There was no reason for Manohara to slander him,” he said.

Outside the court, Tengku Muhammad Fakhry said he was thankful to God, adding that he was happy the decision was in his favour.

He urged all parties to accept the court’s decision. He also expressed hope for Manohara to return to him.

Tengku Fakhry told High Court he suffered from depression

Kelantan prince Tengku Temenggong Tengku Muhammad Fakhry revealed in High Court at Kuala Lumppur yesterday morning that he suffered from depression soon after his 17-year-old wife, Manohara Odelia Pinot left him.

In his statement of RM105 million defamation suit against his wife, Manohara and her mother, 44-year-old, Daisy Fajarina, Tengku Fakhry said he had not only lost business partners and friends, but was also forced to go into hiding since Manohara claims somehow portrayed him as a 'wild animal'.

In addition to that, Tengku Fakhry was blamed for a diplomatic crisis between Malaysia and Indonesia. Indonesians protested and accused him for abusing Manohara. He pointed out that since Manohara left him, he had sleepless nights and forced to move out of the palace. The allegations by Manohara and Daisy tarnished Tengku's reputation for some parties questioned his ability to carry out palace duties.

His estranged wife left without his permission May last year while the couple was on a trip to Singapore. Manohara then held press conferences in Indonesia allegedly slandering Tengku Fakhry and claimed that she was raped, tortured and imprisoned during their marriage.

Manohara said she would never return to Malaysia. Manohara and her mother failed to prove allegations against Tengku Fakhry for both were absent during the court proceeding. High Court set February 24 for subsequent submissions from lawyers.

Court Awards Manohara's Prince 6 million ringgit($1.8 Million) in Defamation Case

A Malaysian prince was awarded 6 million ringgit ($1.8 million) in damages Thursday in a defamation suit against his Indonesian teen wife Manohara Odelia Pinot, who accused him of sexual and physical abuse after fleeing him.

The Kuala Lumpur High Court awarded the sum to Tengku Fakhry Ismail Petra, but he is not likely to receive any payment unless he initiates legal proceedings in Indonesia against his wife. Manohara has so far refused to return or recognize court rulings made against her in Malaysia.

The royal scandal surfaced in May when Manohara left Tengku Fakhry in what she claimed was a dramatic escape from a hotel while accompanying her husband's family on a trip to Singapore. Pinot married the prince from Malaysia's northern Kelantan state in 2008 after she turned 16.

Pinot and her mother told Indonesian media that Fakhry, 32, held her captive and treated her as a sex slave. She also made graphic allegations of physical torture during their marriage.

The prince subsequently filed a defamation suit against Pinot and her mother, both of whom refused to testify in the hearings. The High Court ruled in Tengku Fakhry's favor in November and announced the compensation award Thursday after Pinot failed to appoint lawyers in Malaysia to represent her.

Indonesian laws cannot compel Pinot to heed Malaysian court verdicts, so Tengku Fakhry plans to file a similar suit against Pinot and her mother in Jakarta, said the prince's lawyer, Mohamad Haaziq Pillay.

``We will go into the lion's den to take on the lion,'' Mohamad Haaziq said. ``It is only a matter of time.''
